1. Eligibility
You must be at least 18 years old to create an account. Children under 13 may use Calmiverse only through an account created and supervised by a parent or legal guardian, in accordance with our Children's Privacy Policy.
2. Your account
- Provide accurate information and keep it up to date.
- Keep your password confidential. You are responsible for activity on your account.
- Notify us immediately of any unauthorized use.
2A. Parental Responsibility (COPPA-Aligned)
Parents and legal guardians are responsible for supervising their child's use of Calmiverse, including monitoring screen time, ensuring appropriate breaks, and determining whether the service is suitable for their child's health, sensitivities, and developmental needs.
Calmiverse does not knowingly collect personal information from children under 13 without verifiable parental consent, as described in our Children's Privacy Policy.
3. Acceptable use
You agree not to:
- Use Calmiverse for unlawful, harmful, or abusive purposes.
- Attempt to access another user's account or data.
- Reverse-engineer, scrape, or interfere with the service.
- Upload content that is illegal, hateful, sexually explicit, or that infringes others' rights.
- Use Calmiverse to develop a competing product.
4. Subscriptions and billing
Some features (e.g., Calmiverse Create+) require a paid subscription. Subscriptions renew automatically until cancelled. You can cancel anytime in your account settings; cancellation takes effect at the end of the current billing period. Except where required by law, payments are non-refundable.
5. Your content
You and your child retain ownership of journal entries, garden creations, and other content you submit ("Your Content"). You grant Calmiverse a limited license to host, store, and display Your Content solely to operate the service for your family. We do not use Your Content for advertising or to train external AI models.
6. Our content
Calmiverse, including its software, designs, characters, illustrations, audio, and brand, is owned by Calmiverse, Inc. and protected by intellectual property laws. We grant you a personal, limited, non-transferable, non-exclusive license to use the service for your family's non-commercial use.
7. Not medical advice
Calmiverse offers calming and mindfulness activities; it is not a medical device, therapy, or substitute for professional advice, diagnosis, or treatment. If you have concerns about your child's mental or physical health, consult a qualified professional.
7A. Health & Safety Notice
Calmiverse includes visual effects such as animations, sparkles, color shifts, motion, and other screen-based elements. These may affect users who are sensitive to flashing lights, motion, or visual stimulation, including individuals with photosensitive epilepsy or other neurological or sensory conditions.
By using Calmiverse, you acknowledge and agree that:
- Some activities may include gentle animations or visual effects.
- You and your child should take regular breaks during use.
- If you or your child experience dizziness, nausea, headaches, eye strain, disorientation, or any discomfort, stop using the service immediately.
- Parents and guardians are responsible for supervising their child's use of Calmiverse and ensuring it is appropriate for their child's health needs.
- If you have concerns about how screen use may affect you or your child, consult a qualified medical professional before using Calmiverse.
7B. No Medical Liability
Calmiverse is not designed to diagnose, treat, cure, or prevent any medical condition. We do not guarantee that the service is safe for users with epilepsy, sensory processing differences, visual sensitivities, or other medical conditions.
To the maximum extent permitted by law, Calmiverse is not responsible for:
- Seizures, photosensitive reactions, or neurological events
- Eye strain, headaches, or discomfort from screen use
- Motion sickness or dizziness
- Any injuries or issues arising from prolonged use of the service
- Any health-related conditions triggered or worsened by animations, visual effects, or screen exposure
Parents and guardians are solely responsible for determining whether Calmiverse is appropriate for their child's health and wellbeing.
8. Termination
You can delete your account anytime from settings. We may suspend or terminate accounts that violate these Terms or to protect users or the service. Sections that by their nature should survive termination (ownership, disclaimers, limitations, governing law) will survive.
9. Disclaimers
Calmiverse is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
10. Limitation of liability
To the maximum extent permitted by law, Calmiverse will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, or data. Our total liability for any claim relating to the service is limited to the greater of the amount you paid us in the prior 12 months or US $50.
10A. Additional Limitation of Liability for Health-Related Claims
To the maximum extent permitted by law, Calmiverse will not be liable for any health-related claims arising from or connected to the use of the service, including but not limited to:
- Photosensitive epilepsy or seizure-related events
- Visual or sensory discomfort
- Fatigue, overuse injuries, or screen-related strain
- Behavioral or emotional responses to gameplay or screen time
- Any indirect, incidental, or consequential damages related to health or wellness
Your sole remedy for dissatisfaction with the service is to stop using Calmiverse.
11. Indemnification
You agree to indemnify and hold Calmiverse harmless from claims arising out of your misuse of the service, your violation of these Terms, or your infringement of any third party's rights.
12. Governing law & disputes
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of laws principles. Disputes will be resolved in the state or federal courts located in Delaware, except where applicable consumer-protection law gives you the right to sue locally.
13. Changes
We may update these Terms. Material changes will be announced by email and in-app at least 14 days before they take effect. Continued use after the effective date means you accept the updated Terms.
